By accessing or using the BluCruise website at blucruise.com (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and BluCruise, based in Belgium. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. About Our Service

BluCruise is a cruise travel companion platform that provides:

• Cruise search and discovery (powered by affiliate partnerships with cruise lines and booking platforms)
• Flight search (powered by Kiwi.com via TravelPayouts affiliate programme)
• Port transport and excursion discovery and booking facilitation
• Offline port guides and travel information
• Operator marketplace connecting cruise passengers with local service providers

BluCruise is currently in early access / beta. Some features displayed on the website are under development. We make no guarantee that any specific feature will be available at any particular time.

3. Eligibility

You must be at least 18 years of age to use BluCruise. By using the Service, you confirm that:

• You are at least 18 years old
• You have the legal capacity to enter into binding contracts
• You are not prohibited from using the Service under any applicable laws
• All information you provide is accurate and complete

4. Affiliate Links & Third-Party Services

Affiliate Relationships

BluCruise participates in affiliate marketing programmes. When you click certain links on our website and make a purchase or booking, we may earn a commission. This does not affect the price you pay.

Our affiliate partners include TravelPayouts (Kiwi.com flights), CJ Affiliate/CruiseDirect (cruises), and Viator (excursions). These partnerships are clearly disclosed throughout the site.

Third-Party Websites & Services

Our Service contains links to third-party websites and services. When you click these links, you leave BluCruise and are subject to the third party's own terms of service and privacy policy. We are not responsible for:

• The content, accuracy, or availability of third-party websites
• Any transactions you complete on third-party platforms
• The quality, safety, or legality of services provided by third-party operators
• Any losses arising from your use of third-party services

Prices & Availability

Prices and availability shown on BluCruise are provided by third-party partners and may not be current. Always verify pricing directly with the booking provider before completing a transaction. BluCruise does not guarantee the accuracy of any prices displayed.

5. Bookings & Transactions

For bookings facilitated directly through BluCruise (port transport, excursions):

• All bookings are subject to availability and operator confirmation
• Payment is processed by Stripe on behalf of the relevant operator
• Cancellation and refund policies are determined by the individual operator and will be disclosed at the time of booking
• BluCruise is not a party to the contract between you and the operator/service provider
• In the event of a dispute with an operator, BluCruise may attempt to mediate but is not liable for the outcome

For cruise and flight bookings clicked through to third-party platforms (CruiseDirect, Kiwi.com), your booking contract is with that third party. BluCruise has no control over and accepts no responsibility for those transactions.

6. User Conduct

You agree not to use BluCruise to:

• Violate any applicable local, national, or international law or regulation
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorised access to any part of our systems
• Interfere with or disrupt the Service or servers
• Scrape, copy, or reproduce content from BluCruise without permission
• Post or transmit harmful, offensive, or unlawful content
• Impersonate any person or entity
• Use automated tools to access the Service without our prior written consent

We reserve the right to suspend or terminate access for any violation of these conduct standards.

7. Intellectual Property

All content on BluCruise — including but not limited to text, graphics, logos, button icons, images, audio clips, and software — is the property of BluCruise or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use BluCruise for personal, non-commercial purposes. You may not:

• Reproduce, distribute, or commercially exploit any BluCruise content without written permission
• Remove any copyright, trademark, or other proprietary notices
• Use our logos, brand elements, or trademarks without prior written consent

Photography on BluCruise is sourced from Unsplash and is used in accordance with their licence terms. Third-party cruise line logos are the property of their respective owners and are used for identification purposes only.

8. Disclaimers

Specifically, we make no warranties regarding:

• The accuracy, completeness, or currency of any information on the site (including prices, availability, and destination guides)
• The quality, safety, reliability, or suitability of any third-party service accessible through BluCruise
• That any particular cruise, flight, excursion, or transport service will be available as described
• Any outcomes from using information provided in our port guides or destination content

Travel carries inherent risks. BluCruise does not provide travel insurance, medical advice, or safety guarantees. You are solely responsible for your travel decisions and personal safety.

9. Limitation of Liability

To the maximum extent permitted by applicable law, BluCruise (and its operators, employees, and affiliates) shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage related to your use of the Service or any third-party service accessed through BluCruise
• Unauthorised access to or alteration of your data
• Any interruption or cessation of the Service

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability is limited to the maximum extent permitted by law. For EU consumers, nothing in these Terms limits your statutory consumer rights under applicable EU law.

Our total liability to you for any claims arising from your use of BluCruise shall not exceed the amount you paid to BluCruise directly (if any) in the 12 months preceding the claim. If you have paid nothing, our liability is limited to €100.

10. Indemnification

You agree to indemnify and hold harmless BluCruise, its operators, employees, and partners from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

• Your violation of these Terms
• Your violation of any third party's rights
• Your use of the Service in a manner not authorised by these Terms
• Any content you submit through the Service

11. Privacy

Your use of BluCruise is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to our Privacy Policy.

Our use of cookies and tracking technologies is described in our Cookie Policy.

12. Changes to the Service

BluCruise is in active development. We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time, with or without notice
• Change pricing, features, or access terms
• Update these Terms at any time — significant changes will be communicated via email (if you are subscribed) or by notice on the website

Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — shall survive termination.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.

For EU consumers, you also retain the benefit of any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law.

Any disputes arising from these Terms or your use of BluCruise shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to the competent courts of Brussels, Belgium — unless applicable consumer protection law in your country of residence provides otherwise.

EU residents may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
